INITIAL REPORT SHOWS THE FLAMES STARTED BECAUSE OF A BLOWN TRANSFORMER. SOME HAVE BEEN ALERTED TO BE READY TO LEAVE IN CASE OF AN EVACUATION. TWO FEDERAL HEARINGS HAPPENING THIS MORNING AFTER 1200 HORSES REMOVED. JAMIE LEARY HAS BEEN IN THE COURTROOM SINCE IT STARTED AT 9:00 THIS MORNING. WHAT TO, YOU KNOW? Reporter: THIS FIRST CASE INVOLVED THE DECISION TO REMOVE HORSES FROM A SPECIFIC AREA IN WYOMING. THIS IS A VERY COMMI CATED AREA BECAUSE THERE IS UNFENCED LAND WHICH ALTERNATE BETWEEN PRIVATE AND PUBLIC. THE CAMPAIGN ARGUED TODAY THAT THIS IS A DELIBERATE EFFORT BY THE BLM AND PRIVATE LANDOWNERS TO ELIMINATE WILD HORSES. THEY SAID THE NUMBERS HAVE FALLEN BELOW THE REQUIRED AMOUNT BECAUSE OF BLM’S ACTIONS. IT ALSO IS AGAINST BLM’S DECISION FOR LAND OWNERS TO CALL THE AGENCY AND HAVE HORSES REMOVED IF THEY GRAZE ON THEIR PRIVATE LAND. THE GRAZING ASSOCIATION SAYS THIS IS A GOOD WAY TO MANAGE THE POPULATION. THE AMERICAN WILD HORSE PRESERVATION CAMPAIGN HAS A DIFFERENT OPINION. WE’RE IN COURT TODAY TO DEFEND THE WILD HORSES OF WYOMING FROM A CONCERTED ASSAULT ON THEIR FREEDOM BY THE ROCK SPRINGS GRAZING ASSOCIATION AND OTHER PUBLIC LAND RANCHERS WHO ESSENTIALLY WANT THE PUBLIC LANDS TO THEMSELVES FOR TAXPAYER LIVESTOCK GRAZING AND THEY WANT TO WIPE OUT THE WILD HORSES. WHAT SHOULD HAPPEN, BLM WILL CONTINUE TO GATHER ON THE CHECKERBOARD AND THEY WILL HAVE TO KEEP COMING BACK BECAUSE THE HORSES TRAVEL EVERYWHERE THROUGHOUT THIS 40-MILE BY 80- MILE STRIP OF LAND. THERE IS PUBLIC LAND TO THE SOUTH. PUBLIC LAND TO THE NORTH. MOST IS NOT FENCED SO THE HORSES WILL KEEP COMING ON TO PRIVATE LAND, MOVING BACK TO PUBLIC LAND. IT IS A VERY DIFFICULT PROGRAM TO MANAGE. THE SECOND CASE A LITTLE DIFFERENT. THE STATE OF WYOMING IS SUING THE BLM TO REMOVE THOUSANDS OF HORSES FROM THE RANGE WHERE THERE IS HORSE POPULATIONS THAT ARE ABOVE THE DESIGNATED LEVEL. BOTH THE AMERICAN WILD HORSE ASSOCIATION CAMPAIGN AND THE BLM AGREE IN THIS CASE, BUT THE BLM — THAT THE BLM SHOULD HAVE THE AUTHORITY OVER THOSE NUMBERS OR THE RANGE AND NOT THE STATE. THE STATE IS SAYING AS SOON AS THE POPULATION EXCEEDS THIS NUMBER, THE BLM IS MANDATED TO REMOVE THEM. THE FEDERAL GOVERNMENT AND WE ARE ON THE SAME SIDE IN THE SECOND CASE AND WE’RE SAYING THAT IS NOT TRUE. THE AGENCY HAS BROAD DISCRETION TO DETERMINE WHETHER HORSES NEED TO BE REMOVED BASED ON WHETHER THEY ARE IMPACTING THE EEK LOGICAL BALANCE.
